Here is a general breakdown of the various types of class action lawsuits in which our lawyers and attorneys have plenty of experience.

Bank Overdraft Fees

The bank overdraft fee class action lawsuit is geared towards individuals who have been charged an overdraft fee by their bank despite their bank accounts being overdrawn. At the moment, there is a multi-district litigation (MDL) taking place and a number of individuals have filed bank overdraft fee class action lawsuits, leading to a majority of the country’s banks being investigated. Deficient COBRA Notice

If you are someone who qualified for COBRA health insurance following any relevant life event, including resignation or termination, you will have received a COBRA notice from your employer. If this COBRA notice was in any way deficient or confusing, you may be eligible to join the Deficient COBRA Notice Class Action Lawsuit. A COBRA notice is deemed deficient if your employer did not:

- Identify a termination date for your current health care coverage
- Provide the name of the plan administraton
- Provide information regarding where COBRA premiums should be mailed

FACTA Credit Cards

It is imperative that retailers and businesses, regardless of size, adhere to the rules and regulations as laid out in the Fair and Accurate Credit Transactions Act (FACTA). These rules and regulations are there to aid in reducing the prominence of credit card fraud, and if ignored, can have dire consequences for consumers. Two of the most important rules, as laid out by FACTA, are in relation to credit card receipts. In short, receipts should not:

1. Reveal the credit card’s expiration date
2.Display more than five of the card’s final digits.

Defective 3M Combat Arms Earplugs

Defective 3M Combat Arms Earplugs were distributed by the U.S. military for many thousands of soldiers, from 2003 to 2015, resulting in partial or total loss of hearing. A design flaw, which rendered them too short to be properly inserted into the ear canal made it impossible for the earplugs to provide proper amount of protection. Ultimately, this led to significant hearing damage and loss for the unfortunate veterans who wore them. Mortgage Payment Fee

Companies that are currently under siege are those who charged an extra fee for their clients to pay their mortgage repayments online or by phone. While there are numerous merchants out there who are legally allowed to charge “convenience fees”, the terms laid out in most mortgage agreements prohibit these fees from existing. Standard form mortgage agreements allow loan servicers to pass along only the actual costs of processing payments (as noted above, and usually no more than a few cents). By tacking on excessive amounts, these companies are not only violating the Fair Debt Collection Practices Act and the Rosenthal Act but also their own contractual agreements.
